TERMS & CONDITIONS
House of Jewellery buys products from hundreds of suppliers, some locally, but mostly overseas. We attempt to have stock of all items available at all times, but we are often faced with shortages caused by circumstances beyond our control. These can be caused by delays in supplier shipments due to slow freight forwarding, Australian Customs and/or quarantine issues, changes to models, items discontinued by suppliers or long production delays.
Together with our partner supplier, Grobet USA, some further issues relating to tools and equipment are worth noting. Although we show every item supplied by Grobet USA, Some items shown are not imported as they are not suitable or don't comply with the Australian Statutory Authorities, particularly some electrical products. Any item shown on our website but not stocked, can be specially ordered (indented), & if this is arranged, a 50% deposit of the total purchase price is payable when your order is placed with us. Possible delays due to those reasons mentioned may be encountered.
Because of the ever changing market in jewellers' supplies, we reserve the right to vary any product if and when necessary. We do not publish a price list as this would never be up to date. Please check our prices at time of ordering as we will never knowingly be undersold. We reserve the right to discontinue products at our discretion.
GENERAL CONDITIONS OF SALE
- Payment for the goods shall be made in full by the due date shown as the due date for payment on the Invoice ('the due date'). The seller shall retain title to goods supplied to the buyer until it has received payment in full for them. Goods belonging to the seller shall be stored so they are identifiable as such. That the seller retains title to goods supplied until they have been paid for shall not affect as an unpaid seller.
- Furthermore, if payment is overdue, or the buyer enters into bankruptcy, liquidation, a composition with its creditors, has a receiver or manager or administrator appointed over all or any part of its assets or becomes insolvent, the seller shall be entitled, without prejudice to any other remedy, to repossess goods belonging to it & to enter any premises without notice, for this purpose.
- If any goods belonging to the seller are disposed of by the buyer or an insurance claim is made in respect of them, the seller shall be entitled to trace the sale or insurance proceeds shall be held by the buyer in a separate bank account on trusts for the seller.
- If the buyer fails to make full payment for the goods by the due date the seller may also without notice:
a) Cancel any discount stated on the invoice, in which case the seller shall issue a further invoice in the sum of the discount & payment thereof shall become due immediately, &/or
b) Charge interest on so much of the purchase price that remains unpaid at the rate of 1.5% per calendar month from the date of invoice, in which case the seller shall issue a further invoice for such interest & payment thereof shall become due immediately.
Possession of the goods shall pass to the buyer at the time the goods are loaded onto the vehicle which is to effect delivery of the goods from the seller's premises & the goods shall thereafter be at the buyer's risk.
- In consideration of the seller's freight & insurance charge the seller shall, unless otherwise directed by the buyer, dispatch & deliver the goods to the buyer or as the buyer made direct & shall insure the goods whilst in transit against such risks which the seller considers appropriate. The charge for freight & insurance is solely to the buyer's account & is payable by the buyer to the seller with payment of the goods. The buyer may arrange for such freight & insurance at its own expense, without recourse to the seller, in which event, the seller's freight & insurance charge will not apply.
- The goods are sold by the seller on these Conditions of Sale only & to the exclusion of anything to the contrary in the terms of the buyer's order or other documentation.
